For a food truck or trailer in Lexington, the winning move is usually not buying bare dirt — it is partnering with a commercial property that already has pavement, restrooms, and traffic (especially a gas station or strip center). Empty lots can work only after site work and the right zoning permit.

Approach independent or franchisee-run gas stations / c-stores and shopping-center owners on busy corridors (Sunset / 378, N Lake Dr / SC-6, Augusta Hwy / US-1, S Lake Dr). Offer a simple revenue share or flat monthly pad rent. They pull the Town’s Annual Mobile Food Vendor Zoning Permit; you pull the truck business license + SCDA food permit.

Watch out

Buying a raw commercial lot does not automatically mean you can leave a trailer there. Town ordinance requires: dust-free surface, 30-ft driveway throat, customer restrooms, setbacks, GC/LC zoning, and removing the vehicle nightly. Bare dirt + porta-potty is not enough.

How the rules work

Two different governments matter: the Town of Lexington (stricter, dual-permit model) and unincorporated Lexington County (more flexible temporary service at existing commercial sites).

Town of Lexington

Mobile food vendor ordinance (2022)

  • No street / sidewalk / park vending except permitted special events.
  • Operate only on private commercial property whose owner holds an Annual Mobile Food Vendor Permit.
  • Zoning must be General Commercial (GC) or Limited Commercial (LC).
  • Hours: 8:00 a.m. – 11:00 p.m. (setup from 7 a.m.). Leave every night.
  • 200 ft from active restaurant customer doors (unless written permission).
  • 200 ft from PreK–12 school entrances (unless school approval).
  • Setbacks: 15 ft from property line; 10 ft between units; 10 ft from buildings.
  • Dust-free surface + 30-ft driveway throat; no parking in handicap spots.
  • Customer restroom access required.
  • Self-contained power only (no external hookup).
  • Truck operator: Town business license + food truck decal + hospitality tax + SCDA permit.

Lexington County (unincorporated)

County zoning — temporary service

  • County zoning ordinance allows mobile food trucks as temporary service at existing non-residential developments (confirm current text with Planning).
  • County does not issue business licenses the same way the Town does — land use runs through zoning permits.
  • Still need SCDA retail food / mobile unit permit + commissary (state-level, non-negotiable).
  • Fire marshal inspection (SC Fire Code §319 for mobile cooking vehicles).
  • Hospitality tax may not apply outside municipal limits — still collect state + local sales tax.
  • Property owner written permission is still essential (lease or letter).

As of July 2024, retail food permitting moved to the SC Department of Agriculture. Every mobile unit needs a permitted commissary kitchen (return within 72 hrs if fully self-contained). How many trucks on one lot? (Town)

  • Lots ≤ 10,000 sq ft → max 2 units at once
  • 10,000 – 20,000 sq ft → max 3
  • > 20,000 sq ft → max 4

Host property owners report quarterly which vendors they hosted. Permit expires Dec 31 each year.

Three paths to a legal pad

Gas station, c-store, brewery, strip plaza, car wash, auto shop — already paved, restrooms, GC zoning, traffic. Owner files zoning permit; you pay pad rent or cut of sales.

Gas stations & c-stores as hosts

Public listings almost never advertise “food truck space for rent” at SC gas stations — these deals are made by calling the store manager / franchisee / landlord. Target stations with leftover paved apron, away from pumps, and not already hosting a restaurant.

  • N Lake Dr / SC-6 — Lake Murray corridor, Home Depot, medical/retail; 940 N Lake is the standout small pad.
  • S Lake Dr — QT + residential feed; strong AM drive.
  • Augusta Hwy / US-1 near I-20 Exit 58 — convenience / QSR demand; GC parcels available.

Tier B — secondary

  • W Main St — downtown-adjacent, Circle K presence.
  • Platt Springs Rd / Red Bank — growing, often County; cheaper land.
  • Longs Pond Rd — residential growth + c-store.
